We at Adventure Vitals Travel Agency are excited to help you with your travel. The following terms & conditions (the "Agreement") describe what you can expect from us. By using our services, you are signifying your agreement with the following terms and conditions, on behalf of yourself and all members of your traveling party.

Booking and Payments

1.1. All bookings require a deposit to confirm your reservation. The deposit amount and payment schedule will be specified at the time of booking.
1.2. Final payment for all travel services is due on or before the deadline specified in your booking confirmation. Failure to meet payment deadlines may result in the cancellation of your reservation without a refund.

Cancellations and Refunds

2.1. Cancellation policies vary depending on the travel supplier (e.g., cruise line, airline, hotel). It is your responsibility to review the cancellation terms provided at the time of booking.
2.2. The Agency may charge a non-refundable service fee for cancellations, regardless of the supplier's policy.
2.3. Refunds, if applicable, will be processed in accordance with the supplier's policies. Please allow up to 60 days for processing.
2.4. We reserve the right to charge processing fees in the event of refunds, cancellations and other services. This fee is separate from any cancellation penalties imposed by the travel supplier, airline, cruise line, or hotel, which will be subject to their individual policies. By making a deposit, the client acknowledges and agrees to this cancellation policy.

Changes to Bookings

3.1. Any changes to your booking must be requested in writing. Changes are subject to availability and may incur additional fees, including service fees charged by the Agency.
3.2. Changes made close to the departure date may not be possible.

Travel Insurance

4.1. The Agency strongly recommends that you purchase travel insurance to protect against unforeseen events, including cancellations, medical emergencies, and trip interruptions.

4.2. If you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances of a pandemic, pre-existing medical conditions, and other policy exclusions. Consult the insurance carriers directly for details. Trip insurance or waivers provided by the supplier may not offer insolvency coverage. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to Covid-19 or any other claim under the policy.

4.3. It is your responsibility to review and understand the terms of any travel insurance policy purchased. Adventure Vitals Travel Agency is not a licensed insurance agent; therefore, cannot provide insurance advice.

Agency Responsibility

5.1. The Agency acts as an intermediary between you and travel suppliers, including but not limited to airlines, cruise lines, hotels, and tour operators. We are not responsible for the performance or failure of these suppliers.
5.2. The Agency is not liable for any injury, loss, damage, delay, or inconvenience arising from events beyond our control, including but not limited to acts of God, government actions, or supplier failures.

Traveler Responsibilities

6.1. It is your responsibility to ensure that all travel documents, including passports, visas, and identification, are valid and comply with entry requirements.
6.2. You must adhere to all health and safety guidelines, including any vaccination or testing requirements mandated by travel suppliers or governments.
6.3. Failure to comply with these responsibilities may result in being denied boarding or entry without recourse.

6.4. The traveler is responsible for thoroughly reviewing and verifying the accuracy of all documents sent and received, including but not limited to itineraries, tickets, reservations, and other travel-related information. It is the traveler’s responsibility to promptly notify the travel agent of any discrepancies, errors, or omissions. Failure to report inaccuracies in a timely manner may result in additional costs or missed opportunities, for which the travel agency cannot be held liable.

Pricing and Availability

7.1. All prices are subject to change without notice due to currency fluctuations, fuel surcharges, or supplier changes.
7.2. Pricing is not guaranteed until payment is received and confirmed by the Agency and supplier.

Limitation of Liability

8.1. To the fullest extent permitted by law, the Agency’s liability for any claim arising from this agreement shall be limited to the commission paid to the Agency by the supplier for the affected booking.
8.2. The Agency is not liable for incidental, consequential, or punitive damages.

Complaints and Disputes

9.1. Any complaints must be reported to the Agency in writing within 14 days of the incident.

Privacy Policy

10.1. The Agency collects personal information solely for the purpose of booking travel services. We are committed to protecting your privacy in accordance with applicable data protection laws.

Amendments

11.1. The Agency reserves the right to update these Terms and Conditions at any time. Any changes will be posted on our website and apply to all bookings made after the update's effective date.

Risks of Travel

12.1. We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations.

12.2. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov,  click on "Find International travel Information” then click on "Country Information", and  fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks. Ultimately it is your responsibility to understand and abide by all requirements and restrictions when traveling. This may include the following: health affidavit forms; health screenings prior to departure and/or upon arrival; temperature screenings prior to departure and/or upon arrival; travel reason affidavit forms; online travel authorizations; airline safety & health requirements, such as health forms, screenings, face coverings; in-country requirements, such as periodic temperature checks, quarantine, face coverings; visas. Failure to meet the requirements and/or restrictions puts you at risk for fines, quarantine or deportation at your expense.
